1. Who we are
The filmdna.ca website (the "Site") and the FilmDNA store are operated by:

By placing an order on the Site, you accept these terms of sale. They apply to any distance sale between FilmDNA and a consumer, in accordance with Quebec's Consumer Protection Act ("CPA"). Nothing in these terms limits the rights the law grants you.
2. Our products
FilmDNA sells fine art prints made in our Quebec studio: prints from our catalog (photographs and "film DNA" posters), custom artworks created from videos or images you provide, and giclée printing services. Every piece is printed to order — we keep no printed inventory.
Descriptions, dimensions, media, and prices appear on each product page. Product photographs are representative; slight variations in tone between your screen and the final print are inherent to fine art printing (see section 8).
3. Ordering and formation of the contract
Your order constitutes an offer to purchase. The contract is formed when we send you the order confirmation by email. That confirmation contains all information required by the CPA (description, itemized price, delivery, cancellation and exchange policy) and constitutes your copy of the contract; keep it.
Before payment, the checkout page displays the itemized price: item prices, delivery charges, and applicable taxes (GST/QST or your province's taxes). All prices are in Canadian dollars (CAD). No other fees are added.
We reserve the right to refuse an order (e.g. inadmissible content within the meaning of section 6, obvious pricing error, unserviceable address); in that case you are fully refunded without delay.
4. Payment
Payment is made at the time of ordering, by credit or debit card, through our payment provider Stripe. Your card details are transmitted directly to Stripe and never pass through our servers.
5. Production and delivery
Production times. Since every piece is printed to order, allow up to 21 days of production. For custom artworks, this period runs from proof approval (see section 7).
Delivery. We ship worldwide. The carrier may vary from one order to the next; if you would prefer we not use a particular carrier, let us know before placing your order. Delivery charges and the estimated delivery time are shown before payment and repeated in the order confirmation; additional charges may apply to shipments outside Canada, including to the United States. International shipments: any customs duties, import taxes, or brokerage fees imposed by the destination country are the recipient's responsibility and are not included in our prices.
Late delivery. If your order is not delivered within 30 days of the stated delivery date, you may cancel your order and obtain a full refund, in accordance with the CPA.
Damaged or lost parcel. Every shipment is packed for artwork transport (rigid tube or reinforced flat packaging). If your order arrives damaged, write to us within 7 days of receipt with photos of the parcel and the piece: we will reprint and reship at our expense, or refund you, at your choice. A parcel lost by the carrier is reprinted or refunded in the same way.
6. Content you provide to us (custom orders)
For custom artworks (e.g. a "DNA" piece created from your wedding video, or printing of your photographs), you send us files. By sending them:
- You represent and warrant that you hold the necessary rights to that content (you are its author, or you have permission from the rights holder — e.g. your wedding videographer) and, where applicable, the consent of the people appearing in it.
- You grant us a license limited solely to producing your order. You retain all your rights. We never use your content for any other purpose without your written permission (see also our Privacy Policy).
- You remain responsible for your content. You agree to indemnify us against any third-party claim arising from a breach of the warranties above.
- We may refuse to produce an order whose content is illegal, infringing, hateful, or otherwise inadmissible; the order is then fully refunded.
File quality. We check the resolution of your files before printing and notify you if it is insufficient for the requested format. We are not responsible for quality limits inherent to the source file you approved.
7. Proofs (custom orders)
For custom artworks, we send you a digital proof before printing. Production begins after your written approval. Proof approval confirms content, cropping, and format; color characteristics remain subject to section 8.
8. Color and the nature of fine art prints
Our prints are produced with calibrated color management on individually profiled papers. Even so, an uncalibrated screen displays colors differently than paper: slight differences in tone, contrast, or rendering between the on-screen preview and the final print are normal and do not constitute a defect. The same applies to the natural characteristics of fine art papers (texture, white point). For custom media supplied or specified by the customer (section 2), rendering may differ from our standard papers; in that case we recommend a printed proof, available for $40.
9. Returns, exchanges, and cancellations
Catalog prints. You have 30 days from receipt to return a catalog print in perfect condition, in its original packaging, for a refund or exchange. Return shipping is at your expense; initial delivery charges are not refunded.
Custom artworks. Pieces produced from your content or to your specifications (custom size, media, or cropping) are final sale: they cannot be returned or exchanged, except in the case of a defect, damage, or non-conformity with the order.
Cancellation before production. You may cancel free of charge any order whose production has not started (for custom artworks: before proof approval). Write to us as soon as possible; once production has begun, cancellation is no longer possible, subject to your legal rights.
Legal warranty. Nothing in this policy limits the legal warranty of quality and conformity provided by the Consumer Protection Act (ss. 37 and 38) and the Civil Code of Québec: a product that is defective, damaged, or non-conforming with your order will be reprinted, replaced, or refunded at no cost to you — including a custom artwork.
Statutory cancellation rights under the CPA. The CPA also grants you specific cancellation rights for distance contracts, notably where the required information was not disclosed to you before ordering, where you do not receive your copy of the contract, or in the event of late delivery (section 5). Upon lawful cancellation, the refund is made within 15 days, and you may request a chargeback from your card issuer if we fail to do so.
10. Intellectual property
The Site's content and FilmDNA works ("DNA" images, photographs, texts, software) are protected by copyright and remain our property or that of our licensors. Purchasing a print gives you ownership of the physical object, but no right of reproduction, commercial resale of copies, or exploitation of the work.
Film and series titles mentioned on the Site appear solely to identify the cinematographic work whose colors are analyzed. They remain trademarks of their respective owners. FilmDNA is not affiliated with any studio, distributor, or holder of these marks, and our products are neither sponsored nor endorsed by them. Our "DNA" posters are abstract visualizations of chromatic data and reproduce no imagery from the works.
11. Liability
To the extent permitted by law, our liability under an order is limited to the price paid for it. This limitation does not apply where the law prohibits it, notably in cases of intentional or gross fault, bodily or moral injury, or the rights granted to you by the CPA.
12. Governing law and recourse
These terms are governed by the laws applicable in Quebec. Any dispute falls under the jurisdiction of Quebec courts, including the small claims division, without prejudice to your right to file a complaint with the Office de la protection du consommateur. No clause herein imposes arbitration on you or restricts your consumer remedies.
13. Language
These terms are presented to you in French first. This English version is offered for your convenience; you may choose to be bound by the English version by expressly selecting it. In the event of a discrepancy, the version in which you contracted prevails.
14. Changes
We may modify these terms for the future; the version applicable to your order is the one in force at the time of ordering, sent with your confirmation.
